In 2011 Fred and Ahmed opened negotiations for Ahmed to take a lease of Fred's shop premises, as Fred wanted to moved his business to larger premises elsewhere and Ahmed believed he could start up his own business in the shop premises After some discussion they orally agreed a rent of £24,000 per year with a commencement date for the lease of f November 2011. They subsequently confirmed matters in as exchange of notes in which they also agreed a ton of 15 years. While they negotiated the terms of a formal deed to corporate these terms. (Fred assured Ahmed this was just paperwork for the lawyers') Fred allowed Ahmed to move in and begin expensive renovations on the property prior to opening his business, on condition that Ahmed tarmac the carpark included with the shop, though Ahmad never found time to do that. Subsequently the negotiations for the formal lease dragged on. while Ahmed commenced trading in July 2012, paying Fred £2.000 per month as rent By December 2012, Fred and mod Ahmed had still not signed a formal deed for the shop and Fred said the freehold of the whole property both the flat and the shops to a largo retail chain, Fresco Ltd. This now owners have written to Ahmed telling him to vacate the flat and the shop immediately, as they ware to run their own business at the property. Advise Ahmed.

Now Fred has sold his flat and shop to Fresco Ltd and the new purchaser is asking Ahmed to vacate the flat and shop. Ahmed may be asked to vacate the flat but he cannot be asked to vacate the shop.

In 2008 six friends, Adrian, Bianca, Chris, David, Erica and Fred, purchased a holiday home. They contributed equally to the purchase price and left the conveyancing to Adrian who borrowed a conveyancing book from the library. Adrian told the others that everyone would be an owner and he listed everyone in alphabetical order on the Deed of Transfer as ‘joint owners’. The property was registered at H.M. Land Registry. Fred soon grew bored with always holidaying in the same location so in 2010 he sold his interest to Peter. In 2012 Bianca was having financial difficulties. After discussing her problems with Adrian, Chris, David and Erica, it was agreed that they would buy her interest in the house. However, although they agreed a price, Bianca was killed in a plane crash before they had a chance to speak to their solicitor about completing the conveyancing formalities. Bianca had made a will leaving all her property to her boyfriend Matt. In 2013 Chris developed a serious illness and unfortunately passed away. He had made a will leaving all his property to charity. Before his death, he sent a letter to the other owners by recorded delivery at the property indicating that he was severing his joint tenancy with immediate effect. Peter signed for the letter when it arrived but then forgot about the letter which was later thrown out with rubbish, without being opened.

Co-ownership is concurrent ownership, possession and enjoyment of property. Adrian, Bianca, Chris, David, Erica and Fred have purchased a holiday home together.
